Dear Sir Chris Ghika,

This email is in relation to Justice (Retd.) Qazi Faez Issa, who has been recently elected as a bencher at Middle Temple.

It is concerning that The Honourable Society of the Middle Temple has elected him as a bencher. This decision may have been made without full awareness of the extent to which he has undermined the justice system, compromised the constitution, and contributed to election manipulation and the erosion of human rights in Pakistan.

Rather than writing a lengthy unsubstantiated email, I would like to draw your attention to the following: a letter, several articles by prominent legal observers in Pakistan, and a white paper detailing election rigging facilitated by Justice (Retd.) Qazi Faez Issa.

A letter written by Justice Mansoor Ali Shah (Senior Puisne Judge) to Justice Qazi Faez Issa on 24th Oct 2024. I am copying only three paragraphs here for your quick reference, but I humbly request you to please read the letter in full:

"The proper role of a Chief Justice is to safeguard the rights of all people-defend the independence of the judiciary and secure justice for all. Chief Justice Qazi Faez Isa, like an ostrich, with his head in the sand, remained complacent and indifferent to external influences and pressures on the judiciary. Instead of standing as a bulwark against interference, he opened the gates wide, betraying the judiciary's sacred role as a check and balance on power. He showed neither the courage nor the moral fortitude to defend the judiciary rather ceded ground to those who sought to weaken the courts for their own gain thereby compromising the very foundation of the rule of law.
"His actions have displayed a blatant disregard for collegiality and respect essential to maintaining judicial harmony. Through a pattern of self-righteousness, he consistently failed to engage in dialogue and refused to lead with the consensus-building that is the hallmark of judicial leadership. He has little regard for the judgments of this Court and has contemptuously and unashamedly suggested that they may not be implemented by the Executive, He has fostered bitter divisions and fractured relationships of colleagues within the Court leaving scars on the judiciary that will last long. His tenure will be defined by pettiness, vindictiveness, and a lowly approach to administrative matters, having no grace or humility."
"To stand a Reference and celebrate such a tenure would send a message that a Chief Justice can betray his institution, erode its strength, act petty and low, and still be celebrated as an honorable servant of justice. I am sorry, I in good conscience, cannot stand at a Reference for such a Chief Justice."

As detailed aforesaid, Mr Isa has allowed grave human rights violations against innocent women and political activists to take place with impunity. As a Chief Justice he had wide SUO MOTO powers to out of his own accord take notice, and halt the imprisonment, torture and political victimisation of thousands of women and children. He refused to intervene, infact he is known for mocking victims of violence and political victimization.

His most recent role in facilitating the Executive and establishment in the passage of the 26th Constitutional Amendment Bill has undermined trichotomy of powers and made independent judiciary of Pakistan subservient to the Executive in the most brazen manner.

As an Inns of Court, which serves as a professional home for barristers, you must be aware that any individual who brings the reputation and integrity of the bar in disrepute must not be elevated to such an important status as a ‘Bencher‘ of the Honourable Society of Middle Temple.

I respectfully urge Middle Temple to reconsider their decision. Needless to mention that it has hurt the feelings of 250 million Pakistanis, including 1.6 million who reside in the U.K.
